Choosing the right executor or trustee is paramount. This individual or entity will be responsible for managing your assets, paying debts and taxes, and distributing your property according to your wishes. Consequently, it’s crucial to select someone trustworthy, organized, and capable of handling these responsibilities.

Ordinarily, people choose a close family member or friend. However, sometimes a professional trustee, like a bank or trust company, might be a better option, especially if the estate is complex or there are potential conflicts among beneficiaries.

Moreover, clear communication with your chosen executor or trustee is essential. Make sure they understand your wishes and have access to all necessary information, such as account details and important documents.

Notwithstanding the importance of choosing a trustworthy individual, I’ve encountered situations where family dynamics made the selection process challenging. For instance, there was a case where siblings had differing opinions on who should be the executor. Ultimately, through open communication and careful consideration of each sibling’s capabilities, we were able to reach a consensus that honored the deceased’s wishes.

Another time, a client wanted to name a close friend as trustee but was concerned about potential conflicts of interest. We discussed the pros and cons of using a professional trustee in this scenario and ultimately decided that it was the best course of action to ensure impartial management of the estate.

My advice is simple: don’t delay. The sooner you start planning, the better prepared you will be.
