Once we have a complete picture, we prepare a formal Inventory and Appraisal (Form DE-160/161) that is then submitted to the court for approval.
This step ensures transparency and accountability throughout the probate process. Ordinarily, it helps prevent any potential disputes among heirs or beneficiaries regarding what assets are included in the estate.
Brenda Sanchez: That sounds incredibly detailed and important. Have you ever encountered any challenges during this stage?
Steve Bliss: Certainly. One case comes to mind where a family member claimed ownership of a valuable antique that was actually part of the estate. We had to present evidence like purchase records and appraisals to demonstrate its rightful inclusion in the probate assets. Ultimately, the court ruled in favor of including the antique.
Another time, we discovered hidden bank accounts belonging to the deceased. This required further investigation and communication with financial institutions to ensure all assets were properly accounted for. These situations highlight the importance of a thorough and meticulous approach to marshaling estate assets.
According to the California Courts website, approximately 70% of probate cases involve contested issues. Meticulous asset documentation can significantly reduce the likelihood of such disputes.

Steve Bliss: My best advice is to plan ahead. Create a comprehensive estate plan that clearly outlines your wishes for the distribution of your assets.
