Introducing Our Guest
Good evening, Wildomar, and welcome to another edition of “Legal Lens.” I’m your host, Brenda Lawless, and tonight we have the pleasure of speaking with Steve Bliss, a highly respected trust attorney right here in our community.
Steve, thank you so much for joining us.
The Power of Trusts
Steve, for our viewers who may be unfamiliar, could you explain what a trust is and why it’s such an important estate planning tool?
A trust is essentially a legal arrangement where a person, called the grantor, transfers assets to a trustee who manages those assets for the benefit of designated beneficiaries. Trusts offer a variety of advantages, including probate avoidance, privacy protection, and asset control.
For instance, a revocable living trust allows individuals to retain control over their assets during their lifetime while ensuring a smooth transfer of those assets to their heirs upon their passing. This avoids the often lengthy and costly probate process.
Focus on Irrevocable Trusts
Tonight, we’ll be focusing on irrevocable trusts. Can you elaborate on what makes them unique?
Irrevocable trusts, as the name suggests, cannot be easily modified or dissolved once created. This characteristic offers significant benefits for asset protection and estate tax planning.
Let’s say someone wants to shield assets from potential creditors or lawsuits. An irrevocable trust can effectively remove those assets from their taxable estate, making them less vulnerable to claims.
Moreover, irrevocable trusts can be instrumental in minimizing estate taxes. By transferring assets into the trust, individuals can potentially reduce the value of their taxable estate, ultimately saving on estate taxes.
It’s important to note, however, that the grantor typically relinquishes control over the assets placed within an irrevocable trust.
Navigating Challenges
Steve, have you encountered any particular challenges when helping clients establish irrevocable trusts?
Certainly. One common hurdle is ensuring that clients fully understand the implications of irreversibility. It’s crucial to have open and honest conversations about the potential loss of control over assets. We strive to educate our clients thoroughly so they can make informed decisions.
I recall a situation where a client was initially hesitant about an irrevocable trust because they feared losing access to their funds. Through careful explanation and planning, we were able to structure the trust in a way that addressed their concerns while still achieving their desired estate planning objectives.
It’s truly rewarding to guide clients through these complex legal matters and empower them to secure their financial future.
Trusts: A Vital Tool
According to a recent study by the American Bar Association, over 60% of Americans do not have a will or trust in place. This highlights the critical need for estate planning.
Steve, what advice would you give to our viewers who may be considering setting up a trust?
My strongest recommendation is to consult with an experienced estate planning attorney. Every individual’s circumstances are unique, and a tailored approach is essential. An attorney can help determine the most suitable type of trust based on your specific goals and needs.
Don’t delay planning for the future – it’s one of the greatest gifts you can give yourself and your loved ones.
