Hello everyone, and welcome to our latest interview series where we shed light on the critical work being done to protect our most vulnerable populations. Today, I have the pleasure of speaking with Ted Cook, an elder protection attorney based in sunny San Diego. Ted, thanks for taking the time to chat with me.
What initially drew you to the field of Elder Protection Law?
Well, I’ve always been passionate about social justice and ensuring everyone has a fair chance. As I gained experience in law, I realized that elder abuse is a pervasive issue often overlooked. Many seniors face exploitation, neglect, or even physical harm, and they need someone to stand up for their rights. That’s what motivates me every day – knowing I can make a real difference in the lives of these individuals.
Can you walk us through the general process of Elder Protection?
- Initial Client Engagement
- Case Assessment
- Protective Actions
- Legal Proceedings
- Long-Term Planning
- Case Resolution & Follow-Up
Let’s dive deeper into ‘Protective Actions.’ What are some of the key strategies employed in this stage?
Protective Actions is often where things get really active. We need to act swiftly and decisively to safeguard our clients from further harm. This could involve several steps, depending on the situation.
- If there’s immediate danger, we might file for a restraining order or protective order against the abuser.
- We also frequently collaborate with Adult Protective Services (APS) to investigate claims and ensure the elder’s safety.
- In cases of severe incapacity, we might petition the court for guardianship or conservatorship to protect their finances and make important decisions on their behalf.
“One case I remember vividly involved a woman who was being financially exploited by her own caregiver,” Ted recalls. “The caregiver was systematically draining her bank accounts and isolating her from family. We were able to intervene quickly, freeze the accounts, and get the woman into a safe living situation with proper support.”

They fought tirelessly for him and ensured he remained in his home.” – David Miller, Point LomaTed, any final thoughts for our readers?
