Ted: Absolutely! Think of it as a roadmap with distinct stages, each crucial for ensuring the elder’s safety and security. We begin with Initial Client Engagement, which involves gathering information about the client’s situation and determining potential legal issues. Next comes Case Assessment, where we delve deeper into the specifics of the case, identify applicable laws, and evaluate the risks involved. Then we move on to Protective Actions, taking immediate steps to shield the elder from harm – this could involve obtaining restraining orders or seeking guardianship. Legal Proceedings may follow, depending on the complexity of the case, involving civil lawsuits, criminal charges, or probate court matters. Finally, we focus on Long-Term Planning, helping seniors secure their future through estate planning and advance directives.

Ted: This is where we truly step in to protect the elder. Imagine a senior facing financial exploitation. We might freeze their bank accounts to prevent further losses, initiate power of attorney revocation if someone is misusing it, or even pursue legal action against the perpetrator. When physical abuse or neglect is involved, we work closely with Adult Protective Services (APS) and law enforcement to ensure immediate safety. In severe cases, seeking guardianship or conservatorship may be necessary to provide ongoing protection and manage the elder’s affairs.

What are some challenges you’ve encountered while implementing ‘Protective Actions’?
“I recall a case involving an elder with dementia who lived with her adult son. He was neglecting her basic needs and isolating her from family and friends. While we secured a guardianship, convincing the son to relinquish control was a battle. It took patience, negotiation, and ultimately court intervention.”
