Honest Conversations About Protecting Our Elders

Hello everyone, and welcome back! Today I’m thrilled to be sitting down with Ted Cook of Point Loma Estate Planning APC, an experienced elder protection attorney right here in San Diego. Ted, thanks so much for taking the time to chat with me.

What Inspired You to Focus on Elder Protection?

It’s a pleasure to be here. You know, I’ve always been drawn to helping people navigate challenging situations, and elder protection is a field that truly resonates with me. There’s something deeply fulfilling about advocating for individuals who may be vulnerable and ensuring they receive the care and respect they deserve.

Seeing firsthand the impact of elder abuse or neglect solidified my commitment to this work. It’s heartbreaking, but it also fuels my passion for protecting our seniors.

Can You Walk Us Through the Steps Involved in Elder Protection?

Absolutely. The process typically begins with an initial consultation where I get to know the client and understand their specific circumstances. We discuss their background, concerns, and any potential risks they face. From there, we conduct a thorough case assessment, which involves identifying legal issues, gathering evidence, and evaluating the level of risk.

  • If necessary, we pursue protective actions such as restraining orders, financial safeguards, or changes in living arrangements.
  • Legal proceedings may also be involved, including civil lawsuits or criminal prosecutions.

Throughout the process, I prioritize clear communication and collaboration with my clients to ensure they are informed and empowered every step of the way. Long-term planning is crucial as well, so we often work on estate planning, advance directives, and ongoing oversight to provide lasting protection.

Let’s Dive Deeper into “Protective Actions.” Can You Explain How That Works in Practice?

“Protective actions” are the measures we take to immediately address a threat or risk to an elder. Think of it as stepping in to shield them from harm. This could involve several strategies, depending on the situation.

  • For instance, if there’s a concern about financial exploitation, we might work to freeze bank accounts or prevent unauthorized transfers of property.
  • If physical abuse is suspected, we’ll often seek restraining orders against the abuser.

“We may also need to facilitate a move to a safer living environment, such as an assisted living facility or a trusted family member’s home. Ultimately, the goal of protective actions is to stop further harm and create a safe space for the elder to recover and rebuild.

> “Ted was instrumental in helping my mother navigate a very difficult situation with her caregiver who was taking advantage of her financially. He acted quickly and decisively, preventing further losses. We are so grateful for his expertise and compassion.” – Susan M., Point Loma.
I remember a case where an elderly gentleman was being pressured by a distant relative to change his will. We intervened, filed a petition with the court, and were able to successfully protect his assets and ensure they were distributed according to his wishes.

Another instance involved a woman who was experiencing neglect at a care facility. We worked with Adult Protective Services to investigate the situation and ultimately secured her transfer to a more attentive and supportive environment.
