An Interview with Ted Cook

Ted, what initially drew you to the field of elder protection?

Well, it wasn’t a straight path, you know? I started out like many lawyers, focused on traditional corporate law. But something always felt missing. Then, I had the opportunity to work on a pro bono case involving an elderly woman who was being financially exploited by her own caregiver. Seeing firsthand the vulnerability of seniors and the complex legal challenges they face ignited a passion in me. It’s incredibly rewarding to be able to advocate for those who are often overlooked or taken advantage of.

Let’s dive deeper into “Protective Actions” – what are some of the crucial measures you take to safeguard your clients?

“Protective Actions” is often where things get really intense, but it’s also incredibly gratifying. This stage is all about mitigating immediate risks and creating a safe environment for our seniors. Depending on the situation, we might file for restraining orders or protective injunctions against abusers. We work closely with Adult Protective Services (APS) to report suspected abuse and neglect, ensuring proper investigations are conducted. Sometimes, guardianship or conservatorship becomes necessary if an individual lacks the capacity to make sound decisions for themselves.

There are times when we need to act swiftly to freeze financial accounts or prevent the transfer of assets to protect seniors from exploitation. It’s a delicate balance – respecting their autonomy while intervening decisively to stop further harm.

One instance that comes to mind involved an elderly gentleman whose caregiver was systematically draining his bank account. We were able to work with law enforcement to freeze the funds and eventually recover them for our client. The relief on his face when he realized his life savings were safe again was truly heartwarming.

Are there any common challenges you encounter during this stage of “Protective Actions”?

Absolutely. Sometimes the most challenging aspect is convincing seniors that they are actually being harmed. Many victims of abuse have been manipulated into trusting their abusers, making it hard for them to recognize the danger they’re in. Building trust and rapport takes time and patience.

Another hurdle can be dealing with resistant family members who may be complicit in the abuse or simply unwilling to acknowledge the problem. In these cases, we have to rely on evidence and legal precedent to make our case and protect the vulnerable senior.
