We also have temporary conservatorships used in urgent situations, and LPS conservatorships for individuals needing involuntary treatment due to mental health challenges.”
Let’s delve into the ‘Establishing a Conservatorship’ process. What are some key steps involved?
“It starts with filing a petition in probate or mental health court,” Ted explains. “Notice must be given to the proposed conservatee and relevant family members. The court appoints an investigator, often a social worker, who conducts an independent assessment. A medical or psychological evaluation is crucial to determine capacity. Finally, a judge reviews all information before making a decision.”
Ted, could you elaborate on the ‘Modifying or Terminating Conservatorship’ process?
Ted nods thoughtfully. “Courts periodically review conservatorships to ensure they’re still necessary. Anyone involved – the conservatee, family members, even the conservator – can petition for termination. If the conservatee regains decision-making capacity, the conservatorship ends. We can also replace a conservator if needed.”
One common challenge Ted encounters involves families struggling to agree on whether a conservatorship is necessary. “It’s emotionally charged,” he acknowledges. “I had one case where siblings were deeply divided about their mother’s ability to manage her finances.
