Interview with Moreno Valley Probate Attorney Steve Bliss

Good evening, Moreno Valley and welcome back to Legal Lines. I’m your host, Jessica Ramirez, and tonight we’re talking probate with a local expert, Steve Bliss of Moreno Valley Probate Law.

What is Probate?

Steve, for our viewers who might not be familiar, can you explain what probate is?

Probate is the legal process of administering a deceased person’s estate. It involves identifying and valuing assets, paying debts and taxes, and distributing remaining property to heirs according to the will or state law.

Avoiding Probate with Trusts

Many people want to avoid probate for their loved ones. What are some common ways to do that?

One effective way is setting up a trust. A trust is a legal entity that holds assets for the benefit of designated beneficiaries. There are different types of trusts, but a revocable living trust is often used for estate planning.

Understanding Revocable Living Trusts

Can you elaborate on how a revocable living trust works?

With a revocable living trust, the person creating the trust (called the grantor) maintains control over their assets during their lifetime. They can add or remove assets from the trust, change beneficiaries, or even dissolve the trust altogether. Consequently, this flexibility makes it a popular choice.

The key benefit is that assets held in the trust typically avoid probate upon the grantor’s death. This means the distribution process can be faster, more private, and less costly than traditional probate.

Real-Life Impact of Trusts

Have you encountered any situations where using a revocable living trust made a significant difference for your clients?

I recall one case involving a family with complex assets. The father had passed away unexpectedly, leaving behind a business and several real estate properties. He had established a revocable living trust before his passing. Because of the trust, we were able to transfer ownership of those assets smoothly and efficiently to his wife and children without going through the lengthy probate process.

It was a relief for the family during a difficult time. Avoiding probate allowed them to focus on grieving their loss rather than dealing with legal complexities.

Trusts: A Growing Trend

It seems like more and more people are considering trusts these days. Is that something you’ve noticed?

Yes, absolutely. According to a recent survey by the American Bar Association, roughly 40% of Americans over the age of 50 have considered using a trust for estate planning.

People are becoming increasingly aware of the benefits trusts offer, such as avoiding probate, protecting assets, and providing for loved ones.
