Absolutely! One crucial first step is determining whether probate is even necessary. Probate is the legal process of administering a deceased person’s estate. Not every estate goes through probate, and understanding this distinction can save time and resources.

We begin by examining the total value of the estate. In California, if the gross value of the estate exceeds $184,500, probate is generally required. However, there are exceptions for assets held in certain ways, such as trusts or joint tenancy. These assets bypass probate altogether and transfer directly to the beneficiary.

Consequently, identifying non-probate assets is equally important. This can involve reviewing deeds, bank account titles, and investment statements. For instance, if a home is owned jointly with rights of survivorship, it automatically passes to the surviving owner upon death, avoiding probate altogether.

I remember one case where a client was deeply worried about probate because she thought her mother’s estate exceeded the threshold. After reviewing the assets, we discovered that a significant portion was held in a trust established years earlier. This saved the family considerable time and expense.

It’s estimated that around 70% of estates require some form of probate (American Bar Association). While it can seem daunting, understanding the process upfront allows for smoother execution and minimizes potential complications.
